Terms of service

1. What Graft is

Graft is a CRM and job management platform for UK tradespeople. It helps you manage leads, generate quotes, send invoices, and automate follow-ups.

Graft is not:

• A legal services provider. Nothing in the platform constitutes legal advice.
• A financial advisor. Pricing suggestions are AI-generated estimates based on your own historical data, not professional financial guidance.
• A warranty provider. Any warranty documents generated by Graft are templates for your use. You, as the tradesperson, are responsible for the warranties you issue to your customers.
• An accountancy service. Invoice totals and VAT calculations should be verified by you.

2. Eligibility

You must be 18 or over and operating a legitimate trade business in the United Kingdom to use Graft. By signing up, you confirm this.

3. Your account

You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorised access, contact us immediately at hello@graft.systems.

4. Subscription and billing

• Graft is offered on a monthly or annual subscription basis, billed via Stripe.
• Your subscription renews automatically at the end of each billing period unless cancelled.
• You can cancel at any time from Settings, Billing. Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial months.
• If a payment fails, we will notify you and allow a grace period before restricting access.
• We reserve the right to change our pricing with 30 days' notice. You will be notified by email.

5. AI-generated content

Graft uses artificial intelligence to generate quotes, invoices, document copy, and other content. You are responsible for reviewing all AI-generated content before sending it to your customers. Graft does not guarantee the accuracy of AI-generated pricing estimates, scope descriptions, or document content. Always check before you send.

6. Your data

You own your data. We process it on your behalf to provide the service. You can export all your data at any time from Settings, Account. You can delete your account and all associated data at any time. For full details on how we handle your data, see our Privacy Policy at graft.systems/legal/privacy.

7. Acceptable use

You agree not to:

• Use Graft for any unlawful purpose
• Resell or sublicence access to Graft to third parties
• Attempt to reverse engineer, copy, or replicate the platform
• Upload malicious code or attempt to interfere with the service
• Use Graft to harass, spam, or defraud your customers

We reserve the right to suspend or terminate accounts that violate these terms without notice.

8. Uptime and availability

We aim to keep Graft available at all times but cannot guarantee uninterrupted service. We do not offer a formal SLA at this stage. Planned maintenance will be communicated in advance where possible. We are not liable for losses caused by downtime.

9. Limitation of liability

To the maximum extent permitted by UK law, Graft's total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 3 months prior to the claim.

We are not liable for:

• Loss of profits or revenue
• Loss of data (beyond what we have caused through negligence)
• Indirect or consequential losses
• Actions taken by your customers based on AI-generated quotes or documents

10. Termination

You can terminate your account at any time. We may terminate or suspend your account if you breach these Terms, fail to pay, or use the service in a way that causes harm to others. We will give notice where reasonably possible. On termination, your data will be retained in line with our data retention policy set out in Section 10a below.

10a. Data retention

We retain your data for the following periods:

Active subscription: Your data is retained for the lifetime of your active subscription.

Subscription cancelled or lapsed: Your data is retained for 90 days after your subscription ends. This allows you to reactivate and recover your data within that window. After 90 days, your data is permanently deleted.

Account deletion requested: If you request deletion of your account (via Settings or by emailing hello@graft.systems), your data will be permanently deleted within 30 days of your request.

Financial and billing records: We may retain billing records, invoices, and payment history for up to 7 years as required by UK law (Companies Act 2006). This applies only to records of transactions with Graft, not to your job, customer, or quote data.

Your customers' data: Data you have stored about your own customers (names, addresses, contact details, job records) is subject to the same retention periods above. You remain the data controller for this data. If one of your customers requests deletion of their data, please contact us at hello@graft.systems and we will assist you in fulfilling that request.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
